Human Rights Violation Case in Tragedy Trisakti 1998 is Unresolved

Human rights violation case in tragedy Trisakti is not solved yet, it occurred because of the people who considered as the power behind this case is not arrested. The government is less responsible to reopen the investigation about this case. The Human Rights court in Indonesia didn’t do the role as well as desired.Yearly, on May 12, every people in Indonesia especially the college students celebrate that day as the heroes day, commemorate to the fallen heroes who died in the tragedy of humanity, they are students of Trisakti University, Elang Mulia Lesmana, Hafidin Royan, Heri Hartanto and Hendriawan Sie. On Tuesday May 12 1998, thousands of students gathered for a peaceful demonstration on the campus of Trisakti University, located between the airport and downtown Jakarta. In the afternoon, they left campus and went to the parliament. They urged the Indonesian President at that time, President Suharto, to be resigned as president as soon as desired. The students just had orations and pamphlets as their weapon face with the police who used the bullets. 4 students died in that riot. Then the tragedy known as Tragedy Trisakti. After that, several riots followed that tragedy, like Tragedy Semanggi 1 and 2. On May 21, finally President Suharto resigned as the Indonesian President. The tragedy has been 12 years passed, but Indonesian people always faced with big questions which are not answered yet.

Human rights violation case in tragedy Trisakti 1998 is unresolved, it occurred because of the people who considered as the power behind this case is not arrested yet. Already 12 years since the tragedy Trisakti occurred, it is not yet solved. The government was not arresting the perpetrators who involved in that tragedy. There are many issues and accusations that some justice officials involved in that tragedy as the suspect who responsible with that tragedy occur. 4 students died by their men’s guns. The victim’s family always demanded that the perpetrators responsible for this tragedy occurred must be arrested as soon as possible.

The government was less responsible to reopen the investigation about this case. It was also the one of main reasons why the human rights violation case is still unresolved. Already 12 years passed, the victim’s family didn’t get the justice yet. Nevertheless the government impressed didn’t want to arrest and reveal the perpetrators behind this case. It makes Indonesian people especially the victim’s family not satisfied. Until now they always demand that the perpetrators and the people who involved in this case must be arrested and this case can be solved as soon as possible. They also impressed that didn’t have desire to reveal or arrested the perpetrators but they protects the perpetrators and gives the impunity.

All the reasons why the human rights violation case in tragedy Trisakti occur lead to the role of Human Rights court in Indonesia didn’t run as well as desired. Now the tragedy Trisakti already 12 years passed. After the tragedy and the resignation of Suharto as the President of Indonesia, Indonesia left the era of Suharto and entered an era of democracy that marked by the acknowledgement and respect for human rights. Even, the avowal of the human rights of Indonesian people is guaranteed in UUD 1945 (1945 Constitution) as the highest law in Indonesia. In Indonesia, human rights violation case will be solved in the Human Rights court. But there are many cases that similar with the Tragedy Trisakti was unresolved by Human Rights court, for example one of the human rights violations in Indonesia, the murderer of Munir case was also unresolved yet till now. It’s show that the government takes full control of the system in Human Rights court, the court itself is not stand independent, it properly stands independent as the one law institution which is have a responsibility of completion every human rights violation case and can’t be influenced or controlled by the outside of environmental justice.

There are many explicit desires of some people and of course there are many parties who want to human rights violation case be forgotten, but the human struggle against the power is same as the struggle of memory against the forgetfulness. They died, they gave everything they have including their life to fight to uphold the truth, justice and democracy. Human rights violation case in tragedy Trisakti will be solved, if the people who considered as the power behind this case or named as the perpetrators confess their sins and arrested. And the Human Rights court in Indonesia must be stand independent and run the role as well as desired. It expected can be trap and arrest the perpetrators. And then the government should be done and run the responsibility to solve the human right violation case as well as the Indonesian people desire. It explicitly gives a message to the government of Indonesia “Don’t be mess with the responsibility”.
